Restitution (Restitution) – Action for reinstatement brought by Jewish tenants, who, having left their flat during the exodus of June 1940, were sent two orders by their landlord to pay the rent, and were evicted because they did not pay – Court rejected demand for reinstatement, after having noted that these tenants had voluntarily left their flat, without proving that they had been subjected to any material or moral constraint at that time – The judges of the second instance deduced that the Jewish tenants had not established that they were exempt from paying their rent and that their lease had been temporarily suspended by the events of the war, and that the cancellation clause provided for in the lease had thus been applied.
