The Claimant is not entitled to compensation for his own time under the indemnity provision in the Contract, but may be entitled to some compensation on an assessment of the costs of these proceedings in the usual way (having regard to his being a litigant in person). Such matters are to be dealt with by the costs judge but will be subject to an order for costs being made which I cannot do until I have heard further argument as there may be matters of which I am presently unaware that are relevant. Under Massachusetts law interest will run on the sums due under the Contract at the rate of 12% per annum and I will hear further argument on the amount of such interest and the date from which it should run.
