Provocation to discrimination, hatred or violence against a person or group of persons on the grounds of their origin or their membership or non-membership of a particular religion (Provocation à la discrimination, à la haine ou à la violence à l'égard d'une personne ou d'un groupe de personnes à raison de leur origine ou de leur appartenance ou de leur non-appartenance à une religion déterminée) – The words "There is a power that does not accept integration in France and for which the interests of Judaism are superior to those of French society ... the international assassination force, the communist international, was composed essentially of Jews ..." do not constitute an incitement to discrimination, hatred or violence against a group of people on the grounds of their origin, membership or non-membership of an ethnic group, nation, race or religion – It is not established that these remarks, made in the course of a private conversation with a history teacher and two journalists and reported by one of the latter in his newspaper three days later, were made to be heard by other people or that their author intended them to be published – The public nature necessary for the existence of the offence was lacking.
