Public defamation of a racist nature (Diffamation publique à caractère raciste) – The Court of Cassation found that the decision of the court of second instance was not inadequate or contradictory and that it had correctly assessed the meaning and scope of the contested remarks, thereby justifying its decision – The character played by Dieudonné did not represent the Jewish community as a whole, nor any individual member of that community, but a section of that community which espouses extremist ideas and does not hesitate to resort to extremist acts – The salute of which the defendant was accused could not be compared to a Nazi salute, given the softness of the gesture, which was accompanied by the virtually inaudible word "Israël" or "Israï", but not "Israheil".   Art. 23, 29, 32 Loi du 29 juillet 1881 sur la liberté de la presse, Art. 591 et 593 Code de procédure pénale.
