Discrimination/insult/freedom of expression (Dyskryminacja/znieważenie/wolność słowa) - The Supreme Court held that an allusion to the Jewish theme, although it may arouse unpleasant associations, does not in itself provide a basis for an accusation of antisemitism - Similarly, the belief that some individuals' dislike of the Jewish community is rooted in their behaviour, does not automatically justify an accusation of antisemitism - The Court also emphasised that the use of the word "Holocaust" in a rational and objective manner does not carry pejorative meanings - The Court argued that public debate on such sensitive issues is permissible within the framework of freedom of expression and that the applicant's critical comments could not be considered an unlawful violation of her personality rights.
