The case concerns a prisoner’s participation in the Nazi extermination process at the Chełmno nad Nerem killing center, where he assisted in crimes against the Jewish population and victims of other nationalities by beating prisoners, taking their valuables and belongings, and leading persons condemned to death to gas vans. The Supreme Court held that criminal responsibility under the 1944 Decree could apply to any person, including a prisoner, who knowingly participated in acts contributing to the killing of victims.
