Case Description: The case originated from an article published in the Egyptian newspaper Al Ahram, which was distributed in France. The article was titled "On the day of Shabbat, the Jews' cake, namely unleavened bread, is made with the blood of Arabs". The Public Prosecutor issued an introductory brief (réquisitoire introductif) on April 24, 2001, to open an investigation for provocation to racial discrimination, hatred, and violence. The Court of Cassation dismissed the appeal (REJETTE le pourvoi). It confirmed that the lower court correctly applied the law by declaring the proceedings null due to the procedural error in the Prosecutor's initial brief.
