The subject matter of the dispute concerned the lawfulness of internal party disciplinary measures following allegations relating to antisemitism-related statements and conduct. The court held that reopening a disciplinary procedure that had already been communicated as final, due to public and internal party pressure, was unlawful and unfair. By contrast, the initiation and continuation of a subsequent disciplinary procedure based on new antisemitism-related allegations was considered lawful.
